AGREEMENT REGARDING RISK OF INJURY AND
RELEASE AND WAIVER OF ALL CLAIMES
This agreement is made in
consideration of the team___________________________________ being allowed to
participate in the
I understand that participating in
the tournament will expose players to above hazardous playing surfaces,
physical contact or collisions with other players, spectators, or inanimate
objects on or about the court. I
understand that the sport of basketball is in itself hazardous and may result
in injury to players or other players.
I represent that the player has no
health or physical problems that will interfere with participating in the
tournament.
I agree that I am responsible for
the player’s own safety.
I hereby assume all risks associated
with players’ attendance and participation in the tournament. I further agree that attendance, play and
participation in the tournament shall be at my sole risk and decisions as to whether
or how, a participant plays shall entirely by my responsibility.
I hereby fully and forever release,
discharge, and agree not to sue Lincoln 3 on 3, Lincoln High School, Lincoln
Boys Basketball Booster Club, Graue Inc., McDonald’s, Illico, Jim Xamis Ford, CEFCU, Lincoln Iron and
Metal, Lincoln Chrysler-Dodge-Jeep, Lincoln IGA, State Bank of Lincoln, Awards
Shop, Rick Hamm State Farm Insurance, Logan County Bank, Chris Coyne State Farm Insurance, Lincoln
Printer, Coca-Cola Bottling Co., CITV 5, Peasley Funeral Home and every other
or unnamed or future supporter or patron of the Tournament (hereafter referred
to as “Tournament Sponsors” their officers, directors, agents, employees,
representatives, and successors for any damage sustained or incurred by me
arising out of or in any way associated with players’ attendance at or
participation in the Tournament, including all claims, causes of action or
liability arising out of the negligence of Tournament Sponsors, their agents or
representatives.
I agree to indemnify and hold
harmless Tournament Sponsors, their agents, or representatives from any loss, damage,
or expense sustained or incurred by them arising from any such claims, cause of
action or liability, whether brought by me, anyone acting on my behalf, or by
anyone else.
I understand and agree that this
Release and Waiver shall be binding upon my heirs, assigns, and any person or
entity acting upon my behalf.
I have read the above items of the
Release and Waiver, understand them, agree to abide by them, and hereby
acknowledge that I have read and understand this Release and Waiver.
